The New York Court of Appeals, the state's highest court, has held that noncitizens can have jury trials if they face misdemeanor charges, because deportation can be a collateral consequence of being convicted. The case stems from an assault case against Saylor Suazo, who also is accused of violating a restraining order and would likely face deportation if convicted of the class-B misdemeanor charges against him.
