As of late, there has been an increased concern about stealth or rogue jurors, which is most likely attributable to the number of ongoing high profile criminal jury trials. Yesterday, the Boston Herald ran an op-ed piece on why stealth jurors should be punished for their transgressions. Personally, I believe that this should be a last resort, not a first. Rather than be reactive and punish jurors, courts and attorneys should be more proactive in the vetting of jurors. Specifically, attorneys should conduct their own online investigation of jurors during voir dire.
